Terms of Use
These Terms and Conditions (“Terms”) govern your access to and use of www.heartspanmd.com and any related pages, forms, and content (the “Site”), operated by MK Cardiology, PLLC, a Florida professional limited liability company (“Company,” “we,” “us”). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.
1. Website Use; Eligibility
The Site provides information about HeartspanMD and its preventive cardiology services to patients and other visitors. The Site is intended for adults. To request an appointment, you must be at least 18 years old and meet the eligibility requirements described during scheduling. Using the Site does not by itself create a physician-patient relationship.
2. Relationship to Patient Agreements
These Terms apply only to the public Site. Scheduling, patient registration, clinical services, payment, and consent are governed by any applicable patient agreements, notices, and consents presented through our secure scheduling and clinical systems. If there is a conflict, those agreements control as to clinical services, and these Terms control as to the Site.
3. Appointment Requests and Scheduling
When submitting an appointment request or using a scheduling link, you must provide accurate, current, and complete information. Scheduling, intake, payments, and access to a patient portal may be managed through a third-party service subject to additional terms and privacy notices. Applicable fees and cancellation terms are disclosed as part of the booking process. Submitting a request does not guarantee an appointment or establish a physician-patient relationship.
4. Changes to These Terms
We may update these Terms at any time by posting the revised version with a new “Last updated” date. Where required by applicable law, we will provide additional notice or seek consent. Otherwise, your continued use of the Site after posting constitutes acceptance of the revised Terms.
5. Permitted Use and Restrictions
You may use the Site for lawful purposes, including learning about our practice and services and requesting an appointment. You may not:
(a) scrape, crawl, or use bots or other automated means to access the Site, except standard search-engine indexing;
(b) probe, scan, or test the vulnerability of the Site, or circumvent any security or authentication measure;
(c) interfere with or disrupt the Site or its infrastructure;
(d) copy, modify, or create derivative works from Site content, or reverse engineer any software made available through the Site;
(e) misrepresent your identity or submit false information; or
(f) use the Site in violation of applicable law.
6. Intellectual Property
The Site and all content, features, text, graphics, logos, and software are owned by Company or its licensors and are protected by intellectual property laws. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to view and print Site content for your personal, noncommercial use. All rights not expressly granted are reserved. HeartspanMD and related logos are trademarks of Company or its licensors; other marks belong to their owners.
7. Information You Submit
When you submit information through the Site (for example, a contact or appointment-request form), you agree it is accurate and that we may use it to respond to your request and as described in our Privacy Policy. Do not submit detailed medical information, medical records, payment-card details, or government-ID numbers through unsecured website contact forms. Use the designated secure patient portal for clinical information. Any feedback, suggestions, or ideas you provide about our website or services may be used by us without restriction or compensation to you. Information submitted through our clinical systems is subject to our Notice of Privacy Practices and applicable patient agreements.
8. Privacy
Our Privacy Policy describes how we collect, use, and share information through the Site, including through cookies and similar technologies and information submitted through website forms. It is incorporated into these Terms by reference. Our separate Notice of Privacy Practices describes how protected health information is used and disclosed in connection with clinical care.
9. Third-Party Links and Content
The Site may link to third-party websites or resources. We do not control and are not responsible for them, and a link is not an endorsement.
10. No Medical Advice; Website Information
Site content, including educational materials, service descriptions, pricing, and marketing information, is provided for general informational purposes. It is not individualized medical advice, diagnosis, or treatment and is not a substitute for a clinical evaluation. Use of the Site alone does not create a physician-patient relationship. HeartspanMD does not provide urgent or emergency care through the Site. If you have a medical emergency, call 911.
11. Disclaimer of Warranties
THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT CONTENT IS ACCURATE OR COMPLETE.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, COMPANY AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). Some jurisdictions do not allow certain limitations, so these may not apply to you to the extent prohibited by law. This Section applies to the Site only and does not limit rights or remedies relating to professional medical care that cannot lawfully be limited.
13. Termination and Suspension
We may suspend or restrict your access to the Site at any time, with or without notice, including for violation of these Terms. Sections 6, 7 (as to feedback), 10, 11, 12, and 14 survive termination.
14. Governing Law and Venue
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any dispute arising from these Terms or use of the public Site will be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to their jurisdiction and venue, except where applicable law requires otherwise. This provision does not govern professional medical care.
15. Copyright Concerns
If you believe content on the Site infringes your copyright, please send notice to [email protected] with a description of the work, the location of the allegedly infringing material, and your contact information.
16. General
These Terms, together with the Privacy Policy, are the entire agreement between you and Company regarding the Site. If any provision is unenforceable, the remainder stays in effect. You may not assign these Terms without our consent; we may assign them freely. Our failure to enforce a provision is not a waiver. Notices to us go to [email protected].
